Terms and Conditions for Luxury Massage

1. Introduction

1.1 Agreement to Terms

By accessing and using the services of Luxury Massage, registered under DM in Amsterdam, with permit number ASD1069ND/ESC613, and accessible via https://massages-amsterdam.nl/ (“we”, “us”, or “our”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to all of these Terms, do not use or access our services.

1.2 Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. Your continued use of our services after any such changes constitutes your acceptance of the new Terms.

2. Services Description

2.1 Service Overview

We offer massage therapy services provided by freelance therapists at clients’ locations, primarily hotels.

2.2 Freelance Therapists

2.2.1 Independent Contractor Status

Our therapists are engaged as independent contractors and are not employees of Luxury Massage. As such, they operate autonomously and are solely responsible for the manner and means by which the services are provided. Luxury Massage does not supervise, direct, or control the professional activities or service modalities of these therapists.

2.2.2 No Responsibility for Therapist Conduct

While Luxury Massage endeavors to associate with high-quality freelance therapists, we do not guarantee or take responsibility for the conduct, behavior, or quality of services rendered by these independent contractors. Any issues, disputes, or grievances arising from the conduct or service of a therapist must be addressed directly with the respective therapist.

2.2.3 Therapist Selection and Assignment

Clients do not have the option to select a specific therapist through Luxury Massage. Assignments are made based on availability and suitability as determined by the independent therapists. We make no representations or warranties regarding the compatibility of a specific therapist with a client’s preferences or expectations.

2.2.4 Compliance and Certification

All freelance therapists are required to maintain appropriate certifications and comply with the local laws and regulations applicable to massage therapy in Amsterdam. However, Luxury Massage is not responsible for verifying or ensuring continuous compliance of these therapists with such regulations and standards.

2.2.5 No Endorsement of Therapists

Engagement of therapists through Luxury Massage does not constitute an endorsement of any therapist. We make no representations, warranties, or guarantees concerning the qualifications, expertise, or credentials of any freelance therapists.

2.2.6 Therapist-Client Relationship

The relationship formed is strictly between the client and the freelance therapist. Luxury Massage acts solely as a facilitator and is not a party to any agreement or understanding that may arise between a client and a therapist.

3. Payments and Refunds

3.1 Payment Terms

Payments for our services can be made using various methods, including cash, online transactions, or cryptocurrencies. Upon choosing your preferred payment method, you acknowledge and agree to the terms and conditions associated with that method. We strive to ensure the security and confidentiality of all online and digital transactions. However, Luxury Massage is not liable for any issues arising from payment processing, including but not limited to data breaches or unauthorized transactions.

3.2 Non-Refundable Policy

All charges incurred for services provided by Luxury Massage are non-refundable. This policy applies regardless of the client’s satisfaction with the services rendered and includes situations where a therapist may not spend the entire time scheduled for a session. This non-refundable policy also applies to cancellations, no-shows, or any changes made to the appointment by the client after booking.

3.3 Tips and Additional Payments

Clients may choose to provide tips or additional payments directly to the therapists. These transactions are considered separate from the payments made to Luxury Massage for the booking of services. As such, we hold no responsibility or liability for the management, distribution, or tax implications of these additional payments.

3.4 Extra Services

Luxury Massage facilitates the booking of massage therapy services as specifically outlined and agreed upon at the time of booking. If a therapist offers or a client requests additional services beyond the original agreement, these services are considered outside the scope of our responsibility. We do not endorse, monitor, or take responsibility for any such additional services, and all liabilities arising from these services are solely between the client and the therapist.

4. User Responsibilities

4.1 Compliance with Laws

Users of Luxury Massage services are required to comply with all applicable local, national, and international laws and regulations. This includes but is not limited to adherence to laws regarding public decency, sexual conduct, and respectful behavior. Users are responsible for ensuring that their interaction with freelance therapists does not violate any legal statutes or ordinances.

4.2 Respectful Conduct

Users are expected to maintain a high standard of respect and professionalism when interacting with our freelance therapists. This includes abstaining from any form of harassment, abuse, discrimination, or any behavior that could be deemed as inappropriate or offensive. Failure to adhere to these standards may result in the immediate termination of services and possible legal action.

4.3 Safety and Environment

Clients are responsible for providing a safe and suitable environment for the massage therapy sessions. This includes ensuring the location is secure, clean, and appropriate for the service being provided. Any hazards or potentially dangerous situations must be rectified prior to the therapist’s arrival.

5. Limitation of Liability

5.1 Service Liability

Luxury Massage shall not be liable for any misconduct, personal injury, property damage, or any other damages or losses incurred as a result of interactions between clients and freelance therapists. This limitation of liability applies to direct, indirect, incidental, consequential, special, or punitive damages, even if Luxury Massage has been advised of the possibility of such damages.

5.2 Indemnification

Users agree to indemnify and hold harmless Luxury Massage, its directors, officers, employees, agents, and successors from any claims, liabilities, losses, damages, and expenses, including reasonable attorney fees, arising out of or in connection with the use of our services, violation of these Terms, violation of the rights of any third party, or violation of applicable law.

5.3 Disclaimer of Warranties

Luxury Massage provides its services on an “as is” and “as available” basis without any warranties of any kind, including but not limited to the quality, suitability, truth, accuracy, or completeness of any information or material contained in or presented through our services.
